Di conseguenza, prima che sia formulata una decisione esecutiva nello Stato membro in cui è ubicato il conto bancario, l’autorità giudiziaria dovrà convincersi che il credito vantato dal creditore è legittimo e che senza tale ordinanza vi è il rischio attuale e concreto che il creditore possa vedere pregiudicato, anche solo parzialmente, il suo diritto di credito e che la successiva esecuzione della futura decisione possa essere compromessa o resa assai più difficile.
Consequently, prior to delivery of a judgment enforceable in the Member State where the account is located, the court would have to be satisfied that the creditor's claim appears to be legitimate and that there is a real and ongoing risk that, without the order, the creditor's claim may be impaired, even if only in part, and the subsequent enforcement of his future judgment may be frustrated or made substantially more difficult.
