Con atto introduttivo depositato nella cancelleria della Corte il 31 maggio 1996, la Commissione della Comunità europee ha presentato un ricorso diretto a far dichiarare che, adottando il decreto 9 agosto 1993, n. 93-999, relativo ai preparati a base di foie gras (in prosieguo: il «decreto »), senza aver tenuto conto dei termini del parere circostanziato e del parere motivato della Commissione, relativi al reciproco riconoscimento, la Repubblica francese è venuta meno agli obblighi ad essa incombenti a norma dell'art. 30 del Trattato CE .
By application lodged at the Court Registry on 31 May 1996, the Commission of the European Communities brought an action for a declaration that, by adopting Decree No 93-999 of 9 August 1993 relating to preparations with foie gras as a base ('the Decree'), without taking account of the contents of the detailed opinion and the reasoned opinion of the Commission concerning mutual recognition, the French Republic has failed to fulfil its obligations under Article 30 of the Treaty.
