Tenuto conto degli obiettivi di semplicità ed efficienza in termini di costi, l’organo giurisdizionale dovrebbe ingiungere alla parte soccombente di sopportare soltanto le spese processuali, comprese ad esempio le spese risultanti dal fatto che la controparte era rappresentata da un avvocato o da un altro professionista del settore legale, o eventuali spese derivanti dalla notificazione e/o comunicazione oppure dalla traduzione degli atti, che siano proporzionate al valore della controversia o che siano state necessarie.
Having regard to the objectives of simplicity and cost-effectiveness, the court or tribunal should order that an unsuccessful party be obliged to pay only the costs of the proceedings, including for example any costs resulting from the fact that the other party was represented by a lawyer or another legal professional, or any costs arising from the service or translation of documents, which are proportionate to the value of the claim or which were necessarily incurred.
