Per quanto concerne poi la questione se uno Stato membro, in base al diritto comunitario, possa subordinare il godimento di tale indennità alla condizione della residenza nel suo territorio, la Corte rileva che anche se il trattato CE stabilisce che ogni cittadino dell’Unione ha il diritto di circolare e di soggiornare liberamente nel territorio degli Stati membri, tale diritto di soggiornare non è incondizionato.
Next, as regards the question whether a Member State is, under Community law, authorised to make entitlement to such an allowance conditional on residence in its territory, the Court observes that, even though the EC Treaty provides that every citizen of the Union has the right to move and reside freely within the territory of the Member States, that right of residence is not unconditional.
