69 Peraltro, si deve constatare che, al punto 32 della sentenza impugnata, il Tribunale ha rilevato, a buon diritto, che «l’interesse che possono avere i concorrenti del richiedente di un marchio tridimensionale costituito dalla presentazione di un prodotto di poter liberamente scegliere la forma e il disegno dei propri prodotti non rappresenta, di per sé, un motivo idoneo a giustificare il rifiuto di registrare un marchio siffatto, né un criterio di valutazione, di per sé sufficiente, del carattere distintivo di quest’ultimo».
Furthermore, it should be observed that, in paragraph 32 of the judgment under appeal, the Court of First Instance correctly stated that ‘the interest that competitors of an applicant for a three-dimensional mark consisting of the product’s design may have in being able freely to choose shapes and patterns for their own products is not in itself a ground for refusing registration of such a mark, nor a criterion sufficient in itself for the assessment of the mark’s distinctive character’.
