Dans la version de l’article 43 amendée par le Comité sénatorial, le commissaire peut fournir des avis confidentiels au premier ministre seulement s’il conclut que la personne concernée n’a pas contrevenu à la LCI. Par contre, s’il conclut qu’un titulaire de charge publique y a contrevenu, le commissaire doit faire rapport au premier ministre, remettre un double de son rapport à la personne concernée et rendre son rapport public.
As amended by the Senate Committee, clause 43 permits such advice to be given to the Prime Minister on a confidential basis only if no contravention is found. If the Commissioner concludes that a POH has contravened the CIA, the Commissioner must report to the Prime Minister, make the report available to the public, and provide a copy of the report to the POH who is the subject of the report.
